Since both - the 2020 summer semester and the 2020/21 winter semester - brought many pandemic-related restrictions in the higher education sector, the state of Saxony-Anhalt has initiated an amendment to the higher education law. Due to this change and an associated legal ordinance, the standard period of study for all students enrolled in these two semesters at a university in Saxony-Anhalt and who are not on leave/absence (Urlaubssemester) will be increased by two semesters. If you were only enrolled in one of the semesters in accordance with the conditions mentioned, the standard period of study is usually increased by one semester.
The changes also affect various regulations in the Bundesausbildungsförderungsgesetz . In particular, they concern the maximum funding period to be determined by the BAföG office as well as the point in time at which students have to submit their proof of performance in accordance with Section 48 (1) BAföG.
We would like to inform you about the details of the funding treatment.
1. Proof of performance
Usually, from the fifth semester onwards, BAföG is only paid from the point in time at which the trainee has submitted proof of performance in accordance with Section 48 (1) BAföG. This proves the achievement of the usual performance level of the 4th semester. If the proof of performance cannot be provided, further funding can only be granted if there are special reasons for justification (Section 15 (3) BAföG).
As a result of the new regulations for the standard period of study - under the conditions described above - both the summer semester 2020 and the winter semester 2020/21 will not be assessed as a subject semester within the meaning of Section 48 (1) BAföG. This means that the submission date for the proof of performance is usually postponed by 2 semesters (for those who are first enrolled in the winter semester 2020/21 by 1 semester). Examples:
The Amt für Ausbildungsförderung will determine the relevant postponement of the submission date taking into account the individual requirements and inform the students concerned about the new submission deadline in the course of processing the funding applications, without the need for a separate application .
2. Maximum funding period
The BAföG is paid regularly until the end of the standard period of study (termed in BAföG as the maximum funding period or FHD). Funding beyond the FHD is usually only possible if there are reasons that justify a corresponding measure within the meaning of Section 15 (3) BAföG.
As a result of the new regulations for the standard period of study, the summer semester 2020 and winter semester 2020/21 - under the conditions mentioned above - are not counted as semesters in the maximum funding period. As a rule, this results in an FHD increased by 2 semesters (by 1 semester for those enrolled for the first time in the winter semester 2020/21). Examples:
There is also no need to submit a separate application with regard to the redefinition of the maximum funding period . The Amt für Ausbildungsförderung will determine the applicable new FHD taking into account the individual requirements and inform the students concerned about the new FHD in the course of processing the funding applications. In the case of students who no longer apply for further funding, the Bundesverwaltungsamt responsible for the repayment of the loan portion will be informed about the re-setting of the FHD so that the loan is not due early.
3. Further information
The new regulation also has an impact on students who are currently being funded on the basis of §§ 15 Paragraph 3, 15 Paragraph 3 a, 48 Paragraph 2 BAföG due to the existence of special reasons beyond the maximum funding period or without an existing performance record . Because the semesters mentioned at the beginning are also rated as “0” semesters in these cases, entitlements to further funding are also regularly considered. The students concerned are advised to submit a repeat application before the expiry of the previously set approval period.
